Guanajuato, fifth place in abortions at national level

In the last two years the Attorney General’s Office of the State (PGJE) initiated 55 investigations into the crime of abortion, some of which were against men.

Specialists say that generally the men involved in this type of crime caused the abortion as a result of physical violence against their partner.

In 2017 the figures of the Executive Secretariat of the National Public Security System (SESNP) positioned Guanajuato in fifth place in the country along with Jalisco and Nuevo León for the crime of abortion with 28 recorded cases each. Last year, Guanajuato was eighth, with one abortion less, for a total of 27.

During 2017, the State Judicial Branch via the “Access to Information Platform”, reported three men and two women involved in the process of abortion, and another three people were issued an arrest warrant. They belonged to the municipalities of Acámbaro, Celaya and León.

Four years ago the judiciary registered the conviction of six people for this crime.

The data on criminal incidence is provided to the Executive Secretariat by the Attorney General’s Offices and the General Prosecutor’s Offices of the 32 states of the country and refer to the alleged occurrence of crimes registered in preliminary investigations or investigative files.

Francisco Salgado Romero, member of the Bar Association of León, explained that the law indicates up to eight years in prison for those who provoke, cause or induce an abortion, as well as the loss of exercising their profession to those responsible as doctors, midwives or nurses.

The lawyer said that there are abortions that the authorities don’t notice; for example, when the husband or partner physically attacks the woman and causes the abortion. Although he said that in some cases this action is reported by the affected woman or a relative.

 

The Penal Code of the State of Guanajuato, in its Article 158, states that abortion is the death caused to the product at any time during pregnancy. Whoever runs or provokes one will be sentenced from six to eight years in prison.
